"Contract Employees की मेहनत का अब Shoshan नहीं होगा! Supreme Court ने साफ़ कर दिया कि अगर कोई Employee Regular Workers की तरह काम कर रहा है, तो उसे Equal Pay मिलना चाहिए। Bureaucracy की मनमानी और Labor Laws के उल्लंघन पर Supreme Court ने कड़ी टिप्पणी करते हुए Ghaziabad Nagar Nigam के फैसले को पलट दिया और Contract Mali को उनका Haq देने का Order जारी किया। यह Judgment देशभर के लाखों Contractual Employees के लिए मिसाल बनेगा!
Supreme Court ने एक ऐतिहासिक फैसला देते हुए Contractual Employees के Rights को और मज़बूत किया है। Hon'ble Justice Vikram Nath और Justice Prasanna B. Varale की Bench ने Ghaziabad Nagar Nigam के उस Order को Revoke कर दिया, जिसमें Contract Mali की Services को Terminate कर दिया गया था।
Court ने Clear किया कि Contract Employees को उनके Legitimate Rights से वंचित नहीं किया जा सकता और Employer को अपने Statutory Obligations से बचने का कोई हक़ नहीं।
Court ने यह भी कहा कि जो Employees लंबे समय से Permanent Nature का Work कर रहे हैं, उन्हें सिर्फ Contract Basis पर रखकर सस्ते श्रमिक की तरह इस्तेमाल करना Unconstitutional है। Supreme Court ने Nagar Nigam को आदेश दिया कि इन Employees की Appointment को 6 Months के अंदर Regularize किया जाए और उन्हें उनके पिछले वेतन का 50% भुगतान किया जाए।
Bureaucracy को मिला करारा झटका!
Supreme Court ने नौकरशाही को सीधे चेतावनी दी— "Administrative Barriers cannot override Fundamental Labor Rights!" Court ने कहा कि Labor Laws का उल्लंघन कर Contract Workers को Terminate करना न सिर्फ Unjust, बल्कि Illegal भी है।
Labor Laws की अहमियत:
Court ने Uttar Pradesh Industrial Disputes Act, 1947 की Section 6E का हवाला देते हुए कहा कि "Unilateral Changes और Termination पूरी तरह Illegal है, जब तक कि Employee का Salary व Services Regularize नहीं हो जातीं।"
Contract Workers के लिए क्यों Important है यह Judgment?
✅ यह Judgment पूरे देश मेंSupreme Court ने एक ऐतिहासिक फैसला देते हुए Contractual Employees के Rights को और मज़बूत किया है। Hon'ble Justice Vikram Nath और Justice Prasanna B.
