Stopping increment of an employee beyond the jurisdiction of the Collector: MP HC

Gwalior. The Gwalior Bench of the Madhya Pradesh High Court quashed the order of the Gwalior Collector, in which he had ordered to stop the increment of Cooperative Inspector Mr. RD Pachauria. The High Court once again reiterated that the Collector has no right to stop the increment of any employee.

On May 30, 2022, the Gwalior Collector had ordered to stop the salary increment of Cooperative Inspector Mr. RD Pachauria. An appeal was filed against this order by the government employee under the administrative system but no hearing took place. Therefore a petition was presented in the High Court. On behalf of the petitioner, the High Court was told that the Collector has no right to stop the salary increment of any officer or employee. Under Rule 9, only Class III and Class IV employees are empowered to impose minor fines.

Stopping the increment of the employee is a major penal provision which is beyond the jurisdiction of the Collector. In this case the High Court asked the Collector to submit the reply but no reply was given. The High Court directed the Collector to appear but the Collector did not appear. The information presented by the OIC in the court was proved wrong in the court. The High Court imposed a fine of ₹10,000 on the OIC.
